General
These terms and conditions apply to every product or service from Mari-Ve and apply to every individual user of the website who places an order through the webshop, hereinafter referred to as “Buyer”.
When ordering a product from the webshop, the Buyer accepts these terms and conditions. We reserve the right to change our terms and conditions at any time without notice.
The offer
The offer contains a complete and accurate description of the products or services offered. The description is sufficiently detailed to enable the consumer to properly assess the offer.
If an item in our webshop is described unclearly or incorrectly due to an error or mistake, we reserve the right to amend it. In that case, the buyer has the right to cancel the order, after which the full amount will be refunded to their account.
Price
All prices listed are in EURO and include VAT.
Shipping and handling costs are charged separately and are always the buyer's responsibility, unless otherwise stated. You can find these prices under "Shipping and Returns."
The price applicable to the sales agreement is the price in effect at the time of the registered order and as displayed on the website at that time. The price refers to the item described verbatim. Any accompanying photos are for illustrative purposes and may include elements not included with the item and its price.
If an item in our webshop displays an incorrect price due to an error or mistake, we reserve the right to change this price. In that case, the buyer has the right to cancel the order, after which the full amount will be refunded to their account.
Payment
Payment is made electronically. The webshop uses the secure payment system through Shopify. The purchase is completed when we receive confirmation of your payment. Until then, the items ordered remain the property of Mari-Ve.
Warranty
Legal guarantee (only for consumers):
Under the law of September 21, 2004, on consumer protection in the sale of consumer goods, consumers have legal rights. Each item is subject to this legal warranty from the date of purchase by the first owner. Any commercial warranty does not affect these rights.
To make a claim under the warranty, the Buyer must provide proof of purchase and contact Mari-Ve in advance, after which the Buyer must return the item to Mari-Ve at his own expense.
Any defect must be reported within 14 days of discovery. After that, any right to repair or replacement expires. The (commercial and/or legal) warranty never applies to defects resulting from accidents, neglect, falls, abnormal or incorrect use, use of the item contrary to its intended purpose, failure to comply with the instructions or manual, modifications or alterations to the item, rough handling, or poor maintenance. It also does not apply to items with a shorter lifespan or wear and tear items. The warranty is not transferable.
Complaints
Sometimes things don't go as planned. We ask buyers to first report their complaints to us. You can do so by emailing us at info@mari-ve.be. This way, we can work together to find a solution. If that doesn't work, you can file a complaint with the Consumer Ombudsman. You can find this government agency at https://consumentenombudsdienst.be/nl.
As of February 15, 2016, consumers in the EU can also submit complaints via the European Commission's ODR platform. This ODR platform can be found at http://ec.europa.eu/odr.
